These Terms of Service ("Terms") govern your access to and use of the Pixelpulse Infosolution website (the "Site") and the services we provide. By using the Site or engaging us for project work, you agree to these Terms. If you do not agree, please do not use the Site or our services.
1. About Us
Pixelpulse Infosolution is a mobile app development studio operated by JAY VIJAYBHAI SANGHANI, registered under GSTIN 24LXJPS8190N1ZA, with its place of business at 4th Floor, Shop No. 406, Angel Business Center 1, Mota Varachha, Surat, Gujarat 394101, India.
2. Use of the Website
You agree to use the Site only for lawful purposes. You may not:
- Copy, scrape, mirror, or republish the design, code, or content of the Site without written permission.
- Attempt to break, probe, or circumvent the Site's security or interfere with its normal operation.
- Use the Site to send spam, malware, or unlawful communications.
3. Services & Engagements
Any engagement for design or development services is governed by a separate written agreement (Statement of Work, contract, or proposal) signed by both parties. Nothing on this Site constitutes a binding offer to perform services until such an agreement is signed.
4. Quotes & Estimates
Estimates provided through the Site, by email, or in conversation are non-binding indications based on the information shared at the time. Final scope, timeline, and fees are confirmed only in the signed agreement.
5. Payments
Unless otherwise agreed in writing, project fees are payable in INR according to the milestone schedule in the signed agreement. Late payments may attract interest at 1.5% per month. GST is charged in accordance with applicable Indian tax law.
6. Intellectual Property
- Site content — all text, graphics, code, logos, and design elements on this Site are owned by Pixelpulse Infosolution unless otherwise indicated, and are protected by copyright and other laws.
- Project deliverables — IP ownership of work we create for a client transfers to that client only upon full payment, as set out in the engagement contract.
- Pre-existing tools — internal tools, libraries, frameworks, or know-how developed by us before or independently of a project remain our property.
7. Confidentiality
We treat client information shared during enquiry or project work as confidential and use it only for the purpose for which it was shared. We are happy to sign a Non-Disclosure Agreement if requested.
8. Warranties & Disclaimers
The Site is provided "as is" without warranty of any kind. We do not warrant that the Site will be error-free, uninterrupted, or free from viruses. Information on the Site is for general informational purposes only and does not constitute professional advice.
9. Limitation of Liability
To the maximum extent permitted by law, Pixelpulse Infosolution will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site. Our total liability for any claim relating to a paid engagement is limited to the fees paid by the client for the specific deliverable giving rise to the claim.
10. Third-Party Links
The Site contains links to external sites (such as Instagram and LinkedIn). We are not responsible for the content, security, or privacy practices of those third-party sites.
11. Termination
We may suspend or terminate access to the Site at any time, without notice, for conduct that we believe violates these Terms or is otherwise harmful.
12. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Any dispute arising from these Terms or your use of the Site is subject to the exclusive jurisdiction of the courts of Surat, Gujarat.
13. Changes to These Terms
We may update these Terms from time to time. Continued use of the Site after a change means you accept the updated Terms. Material changes will be flagged on the homepage for 30 days.
